1. Agreement Overview

This Terms of Use ("Agreement") constitutes a legally binding agreement between Metamode Pty Ltd, an Australian proprietary limited company based in Brisbane, Australia ("Metamode"), and the Customer ("Customer"). Failure to agree to and adhere to all terms, conditions, and obligations contained herein results in the prohibition of the Customer's use of the Services, requiring immediate discontinuation. Except for ongoing obligations, such as payment for services rendered, the relationship between Customer and Metamode shall cease upon termination of this Agreement.


2. Service Plans

Monthly Design Retainer:

Metamode provides ongoing design support for any project with a simple, monthly subscription starting at $8,500 AUD per month. This plan can be customised depending on your specific needs. Each retainer level provides a set quantity of maximum hours in a given month, and each item or scope must not exceed those hours. If the allocated hours are exceeded, additional time will be billed at the rate of $160/hour AUD, provided there is explicit approval from the Customer. The Monthly Design Retainer includes no-code solutions only for the development of website designs created by Metamode, clear timeline and milestone deliverables, and expert project management with weekly asynchronous updates, offering flexibility and consistent support for businesses with ongoing design needs. Custom web development or software engineering beyond no-code implementation may be scoped separately and quoted as an additional service.

Custom Projects:

For more comprehensive needs, Metamode offers Custom Projects starting at $10,000 AUD. This option includes a dedicated designer with direct Slack access, custom development or no-code solutions, milestone-based delivery with clear deliverables, and brand & storytelling strategy. Custom Projects are ideal for businesses requiring intensive design work or complete brand transformations.

All plans include ongoing support from a Project Manager to ensure project continuity and alignment with customer goals. Metamode reserves the right to adjust, enhance, or revise these plans at its sole discretion. Customers are encouraged to review the terms regularly to stay informed of any changes.


3. Cancellation and Renewal Policy

For Monthly Design Retainer plans, Customers may cancel their subscription with Metamode by submitting a clear and unequivocal written notice at least twenty-one (21) days prior to the end of the current billing cycle, or by cancelling their subscription directly through their provided Stripe login. This notice period is crucial as resources, including dedicated designers and project managers, are allocated based on anticipated project continuation. Therefore, Metamode does not offer refunds once these resources have been assigned and work has commenced.

After submitting a cancellation notice (or cancelling via Stripe), Metamode will continue to provide services until the end of the current billing cycle. The subscription will not be renewed, and no further charges will be incurred after the billing cycle concludes.

If a cancellation request is received without the proper 21 day notice period, the billing cycle will renew as planned and the cancellation will take effect at the end of the next billing month.

For Custom Projects, payment terms and cancellation policies will be outlined in the project proposal and agreement. Typically, Custom Projects require an initial deposit, with remaining payments tied to specific project milestones.


4. Acceptance of Work

Metamode provides a review period of three (3) business days following the delivery of design work for the Customer to evaluate and provide feedback. The Customer's input is invaluable for ensuring the final product meets their expectations.

Should Metamode not receive feedback or revision requests within the three (3) business days post-delivery, the work will be considered accepted, and the Metamode team will move forward with the next task. This acceptance is procedural and does not prevent the Customer from providing additional feedback or requesting iterations afterward. Metamode is committed to accommodating further refinements; however, it is understood that this will not delay the ongoing project timeline or the subscription billing cycle.
